Consultation has concluded

By-laws are supplementary legislation set by councils for their area to regulate matters at a local level, which are not captured within other legislation. They are designed to provide for safety, convenience and good governance within the council area and contribute to enhancing and maintaining safety and amenity.

Council now invites feedback in relation to the draft by-law Dogs (Miscellaneous) Amendment By-law No. 8 which proposes amendments to the current Dogs By-Law.

Explanation of the primary change to the by-law

The original draft by-law did not permit a dog within five metres of a children’s playground, with the intent of reducing the risk of incidents between children and unfamiliar dogs.

However the Legislative Review Committee (LRC) was concerned about the passive breach of the by-law by a person walking a dog on a path or road within five metres of an enclosed children’s playground.

While it was never Council’s intent to prosecute people lawfully using a road or pathway adjacent a children’s playground, the LRC maintained its concerns and considered disallowing the by-law.

For this reason Council is amending the by-law and removing the reference to “within five metres of” as it relates to a children’s playground or skate park. Because of this amendment, Council is legislatively required to conduct a further period of community consultation. Notwithstanding this amendment, dogs will still not be permitted within a children's playground.

Amendments to gender terminology have also been proposed by the LRC.
